Mo – Beta Program – Terms & Conditions

These Terms and Conditions govern the access to and use of the Mo service provided by Alan. Alan reserves the right to amend these Terms at any time, as detailed in Article 9.1 below.

For the purposes of these Terms, the following capitalized terms shall have the meanings ascribed to them below:

• "Alan" means the company Alan Tech, a simplified joint-stock company (société par actions simplifiée), registered with the Paris Trade and Companies Register under number 908 274 236, having its registered office at 117 quai de Valmy, 75010 Paris, France.
• "Beta Program" means the pre-release, experimental phase of the Service, subject to ongoing testing and development, as described in Article 3.2.
• "Member" means any natural person who meets the eligibility criteria set forth in Article 3.3 and has access to the Service.
• "Mo" or "Service" means the beta program of an artificial intelligence-powered health assistant developed and operated by Alan, as described in Article 2.
• "Terms" means these Mo Beta Program Terms & Conditions, including any future amendments or modifications.

2.1 Mission and purpose

Mo is an, experimental, artificial intelligence-powered health assistant developed and operated by Alan to provide Members with:

• Personalized information and guidance concerning mental health, physical health, and general wellbeing matters;
• Orientation towards appropriate healthcare professionals or medical institutions ;
• Convenience support for insurance-related questions within the scope of the Member's active Alan Insurance policy.

2.2 Artificial intelligence and technology

Mo operates using artificial intelligence systems, including large language models and natural language processing technologies. 

By agreeing to these terms, Members expressly recognise that responses generated by Mo are:

• Automatically produced based on user inputs, previous messages, and available member context (as detailed in article 3.1 of the present terms and conditions) ;
• Subject to limitations inherent to AI systems, including potential inaccuracies, incompleteness, or outdated information;
• Continuously improved through iterative improvements and feedback mechanisms during the Beta phase.

2.3 Data sources and service improvement

(a) Technology infrastructure

As of the date of publication of these Terms, Mo is powered by advanced artificial intelligence models provided by third-party technology vendors:

• Azure OpenAI Service: GPT-4.1, GPT-4o, and GPT-5.1 models hosted in the European Union;
• Google Cloud Platform: Gemini 2.5 Flash model and speech-to-text conversion services, and Claude Sonnet 4 model.

Alan does not train, retrain, or modify the weights or parameters of these foundational AI models using Member conversations or data. 

All the Member data collected and processed by Mo is subject to the following safeguards:

• Hosting and localization: all Member data processing and hosting occur exclusively within the European Union on infrastructure provided by Microsoft Azure, Google Cloud Platform, and Amazon Web Services, all of which utilize Health Data Hosting (HDS) certified environments. 
• Contractual protection: Alan has executed strict Data Processing Agreements with these vendors to ensure they act solely as data processors, explicitly prohibiting them from using Member conversations to train their own AI models or sharing data with third parties. 
• Encryption and control: furthermore, all data is encrypted in transit and at rest, stored in isolated database schemas, and remains under Alan's exclusive ownership and control.

(b) Data sources for Mo's responses

Mo generates responses based on:

• Pre-trained large language models provided by third-party technology vendors;
• Publicly available medical and health information resources;
• Alan's curated health information databases and approved medical content;
• Contextual information from your interactions with Alan's services, as described below.

(c) Personalization of responses

Mo may personalize its responses to your specific situation using:

• Conversation history: Your previous conversations with Mo within the current session and historical interactions;
• Identity information: Information associated with your Alan insurance policy, including:
• Your age and gender, as well as the age and gender of beneficiaries on your policy (e.g., partner, children);
• This information enables Mo to tailor guidance based on age-appropriate and gender-relevant considerations;
• Insurance claims history: With your explicit consent (collected during Mo onboarding), Mo may access your care history with Alan, including:
• Past healthcare services utilized (consultations, examinations, treatments);
• Reimbursement records for medical care;
• This contextual medical history allows Mo to provide more accurate and relevant guidance without requiring you to manually re-explain your medical background.

Important safeguards: Your conversations with Mo and the data accessed by Mo are never used for:

• Insurance underwriting or risk assessment;
• Premium calculations or adjustments;
• Policy modifications or coverage determinations;
• Claims approval or denial decisions;
• Any insurance-related decisions affecting your contract with Alan.

3.1 Territorial scope

The Service is currently available exclusively within the territory of France during the Beta phase. 

3.2 Beta Program nature

Mo is provided as a beta, pre-release service (the "Beta Program"). 

This means that by agreeing to these terms, Members expressly accept and recognise that:

• The Service is experimental and subject to ongoing development, testing, and evaluation;
• Features, functionalities, and availability may be modified, suspended, or discontinued at any time without prior notice;
• The Service may contain errors, bugs, inaccuracies, or technical defects;
• Performance levels are not guaranteed and may vary significantly.

3.3 Eligibility criteria

Access to the Beta Program is reserved for individuals who meet all of the following conditions:

• Are at least eighteen (18) years of age;
• Hold a currently active health insurance policy with Alan Insurance;
• Maintain their insurance policy in good standing throughout their participation in the Beta Program;
• Accept these Terms & Conditions in their entirety without reservation.

3.4 Termination of eligibility

Alan reserves the right to immediately terminate or suspend access to Mo if:

• The Member's health insurance policy with Alan Insurance is cancelled, suspended, or expires;
• The Member violates any provision of these Terms;
• Technical, operational, or safety reasons require such action.

4.1 Services provided

Within the scope of the Beta Program, Mo provides the following services:

(a) Health information and guidance:

• General information on common health conditions, symptoms, and wellness topics;
• Personalized guidance based on Member inputs and historical interactions;
• Suggestions for self-care measures and lifestyle modifications, where appropriate.

(b) Healthcare navigation:

• Identification of relevant healthcare professionals or medical institutions based on the Member's needs;
• Information on available care pathways within the Alan network or French healthcare system;
• Assistance in understanding when and how to seek professional medical care.
• Redirections to digital chat with a health professional of the Alan team, through Alan Clinic, and redirections to video consultations with healthcare professionals.

(c) Insurance member support:

• Information regarding coverage, reimbursement procedures, and policy benefits;
• Clarification on administrative processes related to the Member's Alan health insurance policy.

4.3 Prevalence of official insurance contract and policy 

Your official insurance contract and policy documents always take precedence over any information provided by Mo. If Mo’s guidance about your coverage conflicts with your official documents or written communications from Alan, the official documents shall prevail. Mo’s answers are provided for convenience only and do not create contractual commitments.

4.4 Service availability

Alan does not guarantee uninterrupted or error-free access to Mo. The Service may be temporarily unavailable due to:

• Scheduled or emergency maintenance operations;
• Technical failures or system overload;
• Security measures;
• Operational scaling requirements during the Beta phase.

Alan will endeavor to provide reasonable advance notice of planned service interruptions where feasible, but is under no obligation to do so during the Beta phase.

5.1 Medical Safety Reviews by healthcare Professionals

5.1.1 Purpose and scope

To protect Member’s safety, responses generated by Mo are subject to real-time medical safety oversight by our AI powered flagging system and Alan's healthcare professionals (the "HP" or "Healthcare Professionals") .

Medical safety reviews are conducted exclusively to:

• Identify and correct any medical errors or potentially inaccurate, incomplete, misleading or dangerous information provided by Mo;
• Enable immediate intervention when Mo's guidance could result in harm to a Member's physical integrity or vital interests.

5.1.2 Automated flagging system

After Mo generates each response to a Member:

• An AI-powered flagging system (operating separately from Mo) automatically analyzes Mo's response to assess potential medical safety concerns.
• The flagging system assigns one of two severity levels:
• No review needed: response appears safe and appropriate;
• Review needed: response presents potential safety concerns requiring immediate HP attention, mostly in cases of sensitive medical queries.

We also include a random sampling of conversations (approximately 0.5% of Mo’s answers) for reviews.

5.1.3 Healthcare Professional review process

(a) Conversations to review:

When the flagging system assigns an "review needed" classification:

• The conversation is immediately routed to an available HP within Alan's medical team;
• The HP reviews the complete conversation context and Mo's flagged response;
• The HP must complete the review promptly after the flag is being raised. We aim to review within 15min from 7am to midnight, and within 3 hours from midnight to 7am.

(b) HP intervention powers:

If the HP determines that Mo's response poses a risk to the Member's safety or that inaccuracies cannot be left uncorrected, the HP may:

Correct Mo in the chat:

• The HP provides corrective guidance to Mo through a specialized interface;
• Mo automatically generates and sends a corrected message to the Member;
• The corrected message clarifies, supplements, or modifies the original response;
• The Member receives the correction in real-time within the Mo chat interface.

Contact the Member directly:

• The HP may telephone the Member using the phone number associated with their Alan account;
• Direct contact is reserved for situations where immediate verbal communication is necessary to protect the Member's health;
• The HP will explain the safety concern and provide appropriate medical guidance.

5.2 Product development reviews

Restricted personnel from Alan's product and technical teams may review pseudonymized conversations, strictly to:

• Improve our service and develop new features;
• Enhance and update medical guidelines given to Mo;
• Detect and fix technical issues.

Access is strictly controlled and limited to authorized personnel, fully audited and governed by Alan’s internal confidentiality policy.

6.1 Alan's commitments

Within the limitations inherent to the Beta Program, Alan commits to:

• Provide the Service with reasonable care and diligence;
• Implement appropriate technical and organizational security measures to protect Member data in accordance with applicable data protection regulations;
• Respond to Member feedback and reported issues submitted to [email protected] within a reasonable timeframe;
• Comply with applicable French and European Union laws.

6.2 No warranty – Beta nature

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" DURING THE BETA PHASE. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ALAN MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement;
• Warranties that the Service will be error-free, secure, or available without interruption;
• Warranties regarding the accuracy, completeness, reliability, or timeliness of information provided by Mo;
• Warranties that defects will be corrected or that any particular results will be achieved.

6.3 Limitation of liability

As Mo is a service provided on an experimental basis, Alan’s liability is limited as follow: 

(a) Excluded damages

To the maximum extent permitted by French law, Alan shall not be liable for any indirect, incidental, consequential, or special damages including without limitation:

• Loss of profits, revenue, or business opportunities;
• Loss of data or information;
• Loss of goodwill or reputation;
• Costs of procurement of substitute services.

(b) Essential obligations

Nothing in these Terms shall limit or exclude Alan's liability for:

• Death or personal injury caused by Alan's gross negligence (faute lourde) or willful misconduct (dol);
• Fraud or fraudulent misrepresentation;
• Any other liability that cannot be limited or excluded under mandatory provisions of French law.

6.4 Member acknowledgment

The Member expressly acknowledges and agrees that:

• Mo is an experimental service undergoing testing and development;
• The Member assumes all risks associated with reliance on information provided by Mo;
• The Member will seek professional medical advice for serious health concerns and will not delay or avoid seeking such advice based on Mo's responses;
• Alan is not responsible for decisions made by the Member based on Mo's responses.
  

The Member shall remain liable for:

• Any fraudulent, illegal, or prohibited use of the Service in violation of Article 7;
• Any damage caused to Alan or third parties directly resulting from the Member's intentional breach of these Terms.

7.1 General obligations

By accessing and using Mo, each Member agrees to:

(a) Account security:

• Maintain the confidentiality of their Alan account credentials;
• Immediately notify Alan of any unauthorized access or security breach;
• Accept responsibility for all activities conducted through their account.

(b) Accurate information:

• Provide accurate, current, and complete information when interacting with Mo;
• Update their profile information promptly when changes occur;
• Not impersonate any other person or entity.

(c) Appropriate use:

• Use Mo solely for its intended purpose of obtaining health information and guidance;
• Exercise reasonable judgment and critical thinking when evaluating Mo's responses.

(d) Professional medical care:

• Seek professional medical advice for any serious, urgent, or persistent health concerns;
• Not delay, avoid, or discontinue professional medical care based on Mo's responses;
• Follow the advice of qualified healthcare professionals when a conflict exists between Mo and professional medical guidance.

7.2 Feedback and cooperation

The Member is encouraged to:

• Provide constructive feedback on Mo's performance and accuracy;
• Report errors, bugs, or safety concerns to [email protected]; or by reporting an individual message in the Alan App by long pressing on it and selecting “Report this message” (“Signaler ce message”).

7.3 Prohibited transfers

Access to the Beta Program is personal and non-transferable. The Member shall not:

• Share their account credentials with third parties;
• Allow minors (individuals under 18 years of age) to access Mo through their account;
• Sublicense, resell, or commercially exploit access to the Service.

7.4 Prohibited uses

The Member shall not use Mo to conduct or partake in:

(a) Illegal or harmful activities:

• Engage in, promote, or facilitate any illegal, fraudulent, or harmful activities;
• Generate, distribute, or store illegal content;
• Violate any applicable laws or regulations.

(b) Dangerous medical content:

• Generate or disseminate misleading, inaccurate, or potentially dangerous medical information;
• Seek or provide guidance on illegal drug use, self-harm, or other harmful behaviors;
• Use Mo as a substitute for emergency medical services.

(c) Malicious or harmful content:

• Create or distribute content that incites violence, hatred, harassment, or discrimination;
• Generate defamatory, libelous, or abusive content;
• Promote dangerous or illegal activities.

(d) System abuse:

• Attempt to bypass, disable, or circumvent security measures, access controls, or usage restrictions;
• Reverse engineer, decompile, or disassemble Mo's software, algorithms, or prompts;
• Conduct automated queries, scraping, or data extraction without authorization;
• Deliberately prompt Mo to act contrary to these Terms or its design parameters;
• Disrupt, interfere with, or damage the Service or its infrastructure.

(e) Privacy violations:

• Collect, access, or disclose personal data of third parties without lawful authorization;
• Share health data, personally identifiable information, or confidential data of others without explicit consent;
• Attempt to identify individuals from pseudonymized or anonymized data.

(f) Inappropriate content:

• Generate, request, or distribute sexually explicit, obscene, or pornographic content;
• Create content for deceptive, abusive, or fraudulent purposes;
• Generate and disseminate misinformation or disinformation.

(g) Intellectual property violations:

• Publish, distribute, or share copyrighted content without authorization from rights holders;
• Infringe upon trademarks, patents, trade secrets, or other intellectual property rights.

(h) Minor protection:

• Allow access to or use of Mo by individuals under eighteen (18) years of age;
• Generate content targeted at or designed to appeal to minors.

7.5 Enforcement and consequences

(a) Monitoring:

Alan reserves the right, but is not obligated, to monitor Member usage of Mo for compliance with this Responsible Use Policy.

(b) Violations:

If Alan determines, in its sole discretion, that a Member has violated this Policy, Alan may:

• Issue a warning to the Member;
• Temporarily suspend the Member's access to Mo;
• Permanently terminate the Member's access to Mo;
• Pursue any other remedies available under law or equity.

(c) No obligation to enforce:

Alan's failure to enforce any provision of this Policy shall not constitute a waiver of Alan's right to enforce such provision in the future.

7.6 Reporting violations

Members who become aware of violations of this Policy are encouraged to report them to [email protected].

Alan processes personal data of Members and as a data controller in connection with the provision of Mo.

9.1 Modifications to the Terms

(a) Right to modify:

Alan reserves the right to modify, amend, or update these Terms at any time to reflect:

• Changes to Mo's features, functionality, or scope;
• Legal, regulatory, or compliance requirements;
• Safety, security, or operational considerations;
• Other legitimate business reasons.

(b) Notice of material changes:

In the event of material changes to these Terms, Alan will provide reasonable advance notice before the changes take effect.

(c) Effective date and acceptance:

Modified Terms shall become effective on the date specified in the notice and when published. The Member's continued use of Mo after the effective date constitutes acceptance of the modified Terms.

(d) Right to terminate:

If the Member does not agree with the modified Terms, the Member's sole remedy is to discontinue use of Mo.

9.2 Termination of the Beta Program

(a) Alan's right to terminate:

Alan may terminate the Beta Program, in whole or in part, at any time and for any reason, without prior notice or liability. Reasons for termination may include, without limitation:

• Completion of the Beta testing phase;
• Technical, operational, or business considerations;
• Regulatory requirements or safety concerns;
• Insufficient participation or feedback.

(b) Effects of termination:

Upon termination of the Beta Program:

• The Member's access to Mo will be immediately revoked;
• Alan will have no obligation to continue providing the Service;
• Provisions of these Terms that by their nature should survive (including confidentiality, limitation of liability, governing law, and dispute resolution) shall remain in effect.

9.3 Entire agreement

These Terms, together with Alan's Privacy policy and any other policies expressly incorporated by reference, constitute the entire agreement between Alan and the Member concerning Mo and supersede any prior agreements, understandings, or representations, whether written or oral, relating to the subject matter hereof.

9.4 Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its intent, or if such modification is not possible, it shall be severed from these Terms. The remaining provisions shall continue in full force and effect.

9.5 Waiver

Alan's failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision unless acknowledged and agreed to in writing by an authorized representative of Alan. No waiver of any term shall be deemed a further or continuing waiver of such term or any other term.

9.6 Assignment

The Member may not assign, transfer, or delegate these Terms or any rights or obligations hereunder without Alan's prior written consent. Any attempted assignment in violation of this provision shall be null and void. Alan may freely assign these Terms without restriction.

9.7 Force Majeure

Alan shall not be liable for any failure or delay in performing its obligations under these Terms if such failure or delay is due to circumstances beyond Alan's reasonable control, including but not limited to acts of God, war, terrorism, civil unrest, labor disputes, epidemics, pandemics, governmental actions, internet or telecommunications failures, or other force majeure events.

9.8 Governing law

These Terms shall be governed by and construed in accordance with the laws of France. 

9.9 Dispute resolution and jurisdiction

(a) Amicable resolution:

In the event of any dispute, controversy, or claim arising out of or relating to these Terms or Mo (a "Dispute"), the parties agree to first attempt to resolve the Dispute through good faith negotiations.

(b) Exclusive jurisdiction:

If mediation is not pursued or fails to resolve the Dispute, the parties agree that any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively before the competent courts of Paris, France. Notwithstanding the foregoing, nothing in this Article shall deprive a Member who qualifies as a consumer under applicable French consumer protection law of any mandatory rights under such law, including the right to bring proceedings before the courts of their domicile.

(c) Mediation and European Online Dispute Resolution:

If the Dispute cannot be resolved through negotiations within thirty (30) days, the parties may agree to submit the Dispute to mediation before the Mediator:

If mediation is unsuccessful or if you choose not to pursue it, you remain free to submit your Dispute to the competent courts.

In accordance with EU Regulation No. 524/2013, Members who are European Union consumers are informed of the existence of the European Online Dispute Resolution (ODR) platform accessible at: https://ec.europa.eu/consumers/odr/

9.10 Language

These Terms are drafted in French In the event that these Terms are translated into other languages, the French version shall prevail in case of any conflict or discrepancy.
